A resident of Legon hall of the University of Ghana, Bekoe Daniel Ohene has filed a lawsuit at the SRC Judicial Board seeking among others a declaration that the SRC President, Ms. Esinam Afi Seade acted unlawfully by dismissing the Chairperson of the SRC External Affairs, Derrick Abotsi .
Mr. Abotsi was relieved of his duties on by the President for gross insubordination, non-performance of constitutional duties as well as bringing the name of the University into disrepute at the recently held National Union of Ghana Students Congress in Hohoe.
Article 28(1)(a) states the Removal from office of the Chairperson of Committee be found to be ineffective or inefficient in the performance of his duties; or
(b) Have behaved in a manner that brings or has the potential to bring the SRC into disrepute or is otherwise inimical to the SRC, the said Chairperson shall be liable to be removed from office by a simple majority of the Executive Committee, which shall consider the matter.
But the plaintiff, Mr. Bekoe believes the removal of Mr. Derrick Abotsi from office was inconsistent with the provisions in the constitution and prays the court to declare the President’s actions as null and void.
Below is the relief the plantiff is seeking from the apex court of the University of Ghana SRC.
The Plaintiff, Bekoe Daniel Ohene, of Legon Hall, brings an action before the SRC Judicial Board against The Legal Advisor of the SRC as the nominal defendant, invoking the Board’s original jurisdiction under Article 3(1) and 44(1)(a) of the SRC Constitution seeking the following reliefs:
Meanwhile the Judicial Board of the SRC has set Monday October 17, 2016 for the first hearing of the case. The proceedings will be presided over by Chief Justice of the Judicial Board, Justice Gregory Asiedu.
